The following terms are agreed upon by, firstly, Couette & Nature, included in the Registre des entreprises du Québec and, secondly, the persons who wish to make a purchase via Couette et Nature’s website: www.couetteetnature.ca hereinafter referred to as “the user”. These terms apply exclusively to natural, non-commercial, persons. The parties agree that their relationships will be exclusively governed by this contract, with the exception of any term available in advance on the website. If a term is found to be lacking, it will be considered to be governed by the prevailing customary practices of the distance selling sector whose companies are based in Quebec.
The following terms aim to define the terms of sale between Couette & Nature and the user, from the order to the services, including payment and delivery. They cover all the steps necessary to ordering and ensure the monitoring of the order between the contracting parties.
1. The order
The user can order online, using the online catalogue. The order can only be saved on the site if the user is clearly identified by Couette & Nature. Any order signifies acceptance of prices and of description of products available for sale. Any challenge of this point will happen in the context of an eventual exchange and of the warranties mentioned below. Couette & Nature is committed to honoring orders received via the website until the stock limit of available products is reached. If a product is unavailable, Couette & Nature is committed to informing the user in a timely manner.
2. The delivery
The user has a warranty on most items that allows him or her to return damaged or otherwise unsatisfactory items at his or her cost. Returned items must be sent in their original state and must be complete. Couette & Nature is committed to delivering ordered items in a timely manner. The average delivery time for available items is 3 to 5 days for an at-home delivery.
The user can ask any question and solve any problem regarding his or her relationship with Couette & Nature by speaking directly to a representative via the website by sending an e-mail or via the telephone service from Monday to Friday between 2 PM and 6:30 PM (except holidays).
3. Terms of payment
The user can pay for his or her purchases by bank card or via PayPal. Payments must be carried out in such a manner that the vendor may have the funds on the due date. If products are out of stock or unavailable, payment shall only be taken for the products actually sent.
Prices are indicated in Canadian dollars and legal applicable taxes are added on the day the order is placed. After this date, prices may be subject to change at any moment.
All items may be exchanged or refunded, except when specified otherwise. The exchange must happen, at most, 8 business days from the date of receipt or withdrawal. A refund may also be requested, at most, 8 business days after the date of receipt or withdrawal, except for incidental fees for processing the order. Any exchange or refund request must be made by telephone to our customer service department in order to receive an agreement number.
All items are subject to a contractual guarantee which does not preclude the legal guarantee (RLRQ, c. P-40.1, r. 3). Silk comforters have a 5 year warranty, and bamboo comforters have a 2 year warranty.
Couette & Nature only has the obligation to provide the means for all the steps of accessing the website, for the ordering processes and for later services. Couette et Nature’s responsibility does not extend to inconveniences or damages related to the use of Internet networks, such as disconnection, intrusion by an outsider, the presence of computer viruses or to any fact determined to be force majeure, in accordance with case law.
Couette & Nature reserves the right to collect data on the user by using cookies. Couette & Nature may, for commercial reasons, communicate the user’s identity and contact information to commercial partners. The user can oppose the disclosure of his or her information by writing to firstname.lastname@example.org at any time.
You have the right to access, modify, correct and delete data pertaining to yourself, in accordance with the Privacy Act which came into effect on July 1st, 1983.
All elements of the Couette & Nature website, whether visual or acoustic, including underlying technology, are protected by copyrights, trademarks or patents.
They are the exclusive property of Couette & Nature. The user who has a personal website and who wishes to add, for his or her personal use, a direct link to the Couette & Nature website’s home page, must ask for Couette & Nature’s permission.
In this case, it would not be an implicit affiliation agreement.
However, any hyperlink that sends the user to the Couette et Nature website using framing or in-line linking is strictly forbidden. In any case, any link, even if tacitly authorized, must be removed when asked by Couette & Nature.
In the event of one of the clauses of the present contract being null and void due to a change in legislation or in regulations, or by a court decision, this would not impact the validity and the compliance with the general terms of sale.
These terms apply for the whole duration of Couette et Nature’s online services.
5. Signatures and proof
Computerized registers, maintained in Couette & Nature’s computer systems, and that of its partners, in reasonable security conditions, will be considered as proof of communication, of orders, and of payments that occurred between parties.
Transaction maintenance and archiving:
Archiving purchase orders and bills is done on a reliable and durable platform, in order to obtain a faithful and durable copy.
Applicable law and jurisdiction:
These terms are subject to Quebec laws.
The assignment of jurisdiction in case of dispute, and if there is no amicable settlement between parties, falls to the court of competent jurisdiction.
